1. Protecting your privacy

1.1 We are committed to protecting your privacy and maintaining the security of any personal information received from you.

1.2 We strictly adhere to the requirements of the data protection legislation in the UK and endeavour to ensure that the information that you submit to us remains private, and that it is used only for the purposes described below.

1.4 This Privacy Policy covers treatment of personally identifiable information that we may collect when you are on our websites, if you register with us or when you upload data to or download data from any of them.

1.5 This policy does not apply to companies, organisations or sub-contractors that are not connected to or part of the same organisation as IceBlue Marketing & Design Limited or in relation to websites that IceBlue Marketing & Design Limited does not own or control.

2. General User Activity Information

2.1 We gather general information about users (outside the information referred to in the Cookies Policy), for example, what services users access the most and which areas of our sites are most frequently visited. Such data is used in the aggregate to help us to understand how each of our sites is used.

2.2 We gather this information so that we can continue to improve and develop our services to benefit of our users. We may make this aggregated information available to our commercial partners, to our advertiser clients and also to auditors.

2.3 These statistics are anonymous and contain no personal information and cannot be used as a means to gather such information.

3. Your Personal Information

3.1 When you register with us, use any Interactive Services, or buy a product or service, depending on the sort of service you wish to obtain, we may ask for personal information such as your name, date of birth, contact details, and other details.

3.2 Once you register with any of our sites and accept our Terms & Conditions, you are not anonymous to us and the very nature of our relationship means that we will be aware of your personal data.

3.3 We may use information that you provide to alert you to our own products and services and may contact you regarding changes to the sites to which you are registered or changes to our products or services that you use.

4. Disclosure of Personal Information

4.1 We do not disclose information about your individual visits to any of our sites, or personal information that you provide, such as your name and personal contact details unless you have given us your express permission or we reasonably believe that the law requires it.

4.2 We may record and share aggregated information with our clients. In addition, if you input personal information on a co-branded registration page, then it is possible that the information that you give becomes the property of both ourselves and our client.

4.3 IceBlue Marketing & Design Limited can only confirm its own position in relation to your personal information and cannot be responsible for the information that the client receives in these or similar circumstances.

4.4 We may send personally identifiable information about you to other clients when we:
a) already have your consent to share the information;
b) need to share your information in order to provide the products or services you have requested;
c) have to send the information to companies who work on our behalf to provide a product or service to you. (Unless otherwise stated, these companies do not have the right to use the personally identifiable information we provide to them beyond what is necessary to assist us in providing you the relevant products or services); or
d) are legally obliged to respond to subpoenas, court orders or due legal process.

4.5 Where your data is collected and sent to other organisations for processing that is in both our and their interests, we will be making decisions together in relation to that particular processing and will be ‘joint controllers’ with the organisations involved. Under data protection laws, we will be jointly responsible to you for any processing of that personal data. Where this is not the case, the other organisation will be separately responsible to you and they will set out their responsibilities in their own privacy statement. We do not sell your personal data to anyone.

4.6 We may share your personal data on the basis of legitimate interest with our project partners that include Coventry and Warwickshire Growth Hub and Stoke and Staffordshire Growth Hub.

5. Interactive Services

5.1 Where individuals engage with the ability of our sites to store personal information about them, the way such information is stored means that it can be downloaded or printed off, again, as part of the process an individual will have had to expressly agreed to allowing such information to be downloaded by other users.

5.2 We can offer individuals the option of remaining anonymous but where this option is not taken, individuals must be aware of the possible disclosure of this information to third parties. Those parties are contractually obliged to obtain, store and use that information solely for the purposes for which it is made available by individuals but apart from this, we cannot control third party organisations’ use of such data.

5.3 Individuals should therefore be aware that this disclosure, for the purposes of meeting their expectations, may occur.

6. Other Ways of Ensuring Your Privacy

6.1 If you subscribe for a service in which delivery by you of your personal details is required, you will be given the opportunity to amend your personal details at any time. The option to do this will ordinarily be available from the login page of our sites or other registration or user areas of the sites, particularly those where you may be asked to input your personal login or registration information (such as user name, password or other security data).

6.2 You may unsubscribe from any promotional information that we may send to you by using the unsubscribe function at the bottom of any e-mail you may receive of this nature or by visiting the appropriate website (which will contain a route for you to take action to unsubscribe yourself from such promotional information).

7 How we use your data

7.1 We will only process information that is necessary for the purpose for which it has been collected.

7.2 Where we collect your data from another source, we rely on our legitimate interests as the legal reason to process your data.

7.3 You have the option to withdraw your consent at any time by contacting us using the details below or by using the unsubscribe option provided in our marketing communications.

7.4 We process your data to enable us to provide Customer Support, Improve our Services and respond to complaints, claims and regulators

7.5.1 To respond to any correspondence that you send to us and fulfil customer requests.

7.5.2 To respond to queries, complaints or claims and to manage legal and regulatory requests and requirements.

7.5.3 To provide IT support and services.

7.5.4 To analyse, evaluate and improve our products and services so that we can provide a more useful and enjoyable customer experience.

7.5.5 For example, we use Google Analytics software to collect information about how you use our website. This includes IP addresses. We do not store your personal information through Google Analytics as the data is anonymised before being used for analytics processing and we will not identify you through analytics information. Google Analytics processes anonymised information about: the pages you visit on our website, how long you spend on each page, how you got to the site and what you click on while you’re visiting the site.

7.6 To enforce or protect our legal rights or to establish, bring or defend legal claims.

7.7 To comply with a request from you in connection with the exercise of your rights (for example, the keeping of suppression lists where you have opted not to be contacted for the purposes of marketing).

9.1 There may be some instances where your information is processed or stored outside of the UK and EU. In those instances, we will ensure that appropriate safeguards are in place for that transfer and storage as required by applicable law.

10.1 We may use Social Media Platforms to communicate with you and to promote our products and services. We use your personal information when you post content or otherwise interact with us on our official pages on Facebook, Instagram, LinkedIn and Twitter and other social media platforms. We may also view statistical information and reports regarding your interactions with the pages we administer on those platforms and their content.

11. We take steps to ensure that any third party partners who handle your information comply with data protection legislation and protect your information just as we do. We only disclose personal information that is necessary for them to provide the service that they are undertaking on our behalf.

12. How long do we keep your data?

12.1 We hold your personal information to give us an opportunity to form a relationship with you but we do not keep your personal information in an identifiable format for longer than is necessary.

12.2 There may be occasions where we retain your data after our relationship ends to establish, bring or defend legal claims.

12.3 Exceptions to this:

12.3.1 Where the law requires us to hold your personal information for a longer period, or delete it sooner;

12.3.2 Where you have raised a legal claim, complaint or concern regarding a product or service offered by us, in which case we will retain your information for a period of 6 years following the date of that complaint or query; or

12.3.3 Where you exercise your right to have the information erased (where it applies) and we do not need to hold it in connection with any of the reasons permitted or required under the law.

13. How can you manage the information we hold about you?

13.1 You have the right to:

  • Ask for a copy of the information that we hold about you;
  • Correct and update your information;
  • Withdraw your consent (where we rely on it).
  • Object to our use of your information (where we rely on our legitimate interests to use your personal information) provided we do not have any continuing lawful reason to continue to use and process the information. When we do rely on our legitimate interests to use your personal information for direct marketing, we will always comply with your right to object;
  • Erase your information (or restrict the use of it), provided we do not have any continuing lawful reason to continue to use and process that information;
  • Transfer your information in a structured data file (in a commonly used and machine readable format), where we rely on your consent to use and process your personal information or need to process it in connection with your contract.
  • You also have the right not to be subject to purely automated decisions (including profiling) where this has a significant effect on you. We do not envisage that any decisions will be taken about you in this way, however we will update this statement if this changes.
